Applicable to: Builder / Promoter / Developer / Real Estate Agent / Broker / Property Dealer / Individual Owner / Co-owner / Authorised Representative / Any person or entity uploading or publishing a property listing.
1. ACCEPTANCE OF TERMS
By registering on ChhattisgarhProperty.in and/or submitting, uploading, publishing, editing, renewing or promoting any property listing, I/We confirm that I/We have read, understood and agreed to these Property Listing Terms & Conditions.
These Terms shall apply irrespective of whether I/We are acting as a Builder, Promoter, Developer, Agent, Broker, Property Dealer, Owner, Co-owner or Authorised Representative.

2. IDENTITY AND AUTHORITY
I/We declare that the identity and contact information provided by me/us are true and accurate.
I/We further declare that I/We have the legal right, ownership or proper authority to advertise the property being listed.
If I/We are:
- an Owner/Co-owner — I/We confirm my/our ownership or lawful right to advertise;
- a Builder/Promoter/Developer — I/We confirm authority to advertise the project/property;
- an Agent/Broker/Property Dealer — I/We confirm that I/We have obtained appropriate authority from the owner/promoter or are otherwise legally entitled to advertise;
- an Authorised Representative — I/We confirm that such authority exists and can be produced when required.
ChhattisgarhProperty.in shall not be responsible for determining whether the person uploading a property actually possesses the legal authority claimed by that person.
The uploader shall remain responsible for establishing such authority.

3. COMPLETE RESPONSIBILITY OF THE UPLOADER
I/We expressly acknowledge that the person/entity uploading a property listing is solely responsible for the accuracy, authenticity, legality and completeness of the information submitted by him/her/it.
This responsibility includes, but is not limited to:
- Ownership;
- Title;
- Authority to sell/rent/lease;
- Property location;
- Address;
- Property boundaries;
- Plot area;
- Carpet area;
- Built-up area;
- Super built-up area;
- Dimensions;
- Floor;
- Construction status;
- Age of property;
- Property condition;
- Number of rooms;
- Parking;
- Amenities;
- Facing;
- Road access;
- Price;
- Rent;
- Security deposit;
- Brokerage;
- Availability;
- Possession;
- Construction progress;
- Project details;
- Approvals;
- Permissions;
- Layout;
- Completion/Occupancy Certificate;
- RERA registration/status, wherever applicable;
- Encumbrances;
- Mortgage/lien/charge;
- Litigation;
- Disputes;
- Government acquisition;
- Lease restrictions;
- Existing third-party rights;
- Photographs;
- Videos;
- Maps/location;
- Brochures;
- Floor plans;
- Offers and discounts;
- Investment/return claims; and
- Every other statement or representation made in connection with the listing.

4. TRUTHFUL AND NON-MISLEADING LISTINGS
I/We shall not publish any information that is false, fraudulent, materially incomplete, misleading or exaggerated.
I/We shall not:
- Misrepresent ownership;
- Claim another person's property as my/our own;
- Publish a false location;
- Misstate the property area;
- Publish a false price;
- Use fake photographs;
- Use photographs of another property;
- Publish false amenities;
- Misrepresent construction status;
- Misrepresent possession date;
- Publish false approval information;
- Publish false RERA details;
- Use a fake RERA registration number;
- Make false investment or return claims;
- Create fake discounts;
- Create artificial scarcity;
- Hide material facts known to me/us;
- Advertise a property that I/We are not authorised to advertise.
Any consequences arising from such information shall be the responsibility of the person/entity that submitted it.

5. OWNERSHIP, TITLE AND LEGAL STATUS
I/We understand that listing a property on ChhattisgarhProperty.in does not establish or certify ownership or title.
I/We shall disclose material facts known to me/us that may affect the proposed transaction, including, where applicable:
- Mortgage;
- Bank loan;
- Lien;
- Charge;
- Court proceedings;
- Ownership dispute;
- Family dispute;
- Co-owner claim;
- Government acquisition;
- Stay order;
- Tenancy;
- Lease restrictions;
- Existing agreement;
- Third-party rights;
- Other encumbrances.
Any dispute arising from ownership, title, possession or authority shall remain primarily between the concerned parties and the person/entity responsible for the representation.

6. RERA AND OTHER STATUTORY COMPLIANCE
Where the property/project is governed by the Real Estate (Regulation and Development) Act, 2016, applicable State RERA laws, rules, regulations or other applicable legislation:
I/We agree to comply with all applicable requirements.
Where applicable, I/We shall provide correct and current:
- RERA registration number;
- Project details;
- Promoter details;
- Agent registration details;
- Project status;
- Possession information; and
- Other legally required information.
I/We shall not knowingly advertise or promote a project in violation of applicable RERA requirements.
If any RERA registration/status/details change, I/We shall promptly update the listing.
The uploader acknowledges that publication of a property/project on ChhattisgarhProperty.in does not constitute RERA approval, certification or legal verification by ChhattisgarhProperty.in.

7. BUILDER / PROMOTER / DEVELOPER RESPONSIBILITY
Where I/We are acting as a Builder, Promoter or Developer, I/We additionally confirm that all information relating to the project, including approvals, registration, construction status, specifications, possession, pricing, units and amenities, is accurate and legally permissible to advertise.
I/We shall be solely responsible for compliance with all statutory obligations applicable to the project.
ChhattisgarhProperty.in shall not be deemed to be the promoter, developer, authorised representative or legal representative of the project merely because the project is listed on the platform.

8. AGENT / BROKER / PROPERTY DEALER RESPONSIBILITY
Where I/We are acting as an Agent, Broker or Property Dealer, I/We confirm that:
- I/We are authorised to advertise the property;
- Information supplied by me/us is accurate;
- I/We shall comply with applicable RERA requirements;
- I/We shall provide registration details wherever legally required;
- I/We shall not falsely represent myself/ourselves as the owner;
- I/We shall disclose my/our role where required;
- I/We shall not advertise a property without appropriate authority.
Any dispute between an agent and property owner shall not automatically make ChhattisgarhProperty.in a party to such dispute.

9. INDIVIDUAL OWNER RESPONSIBILITY
Where I/We are listing our own property, I/We confirm that:
- I/We have the right to advertise it;
- The information provided is accurate;
- Co-ownership, where relevant, has not been knowingly concealed;
- I/We shall not upload another person's property without authority;
- I/We shall update the listing when the property is sold, rented, leased, booked or withdrawn.

10. PHOTOGRAPHS, VIDEOS, DOCUMENTS AND CONTENT
I/We confirm that I/We have the right and necessary permission to upload all photographs, videos, floor plans, brochures, documents, logos and other content submitted by me/us.
I/We shall not upload:
- Copyrighted material without permission;
- Another person's photographs without authorisation;
- Forged or fabricated documents;
- Altered documents intended to deceive;
- Confidential documents unnecessarily;
- Personal information of third parties without lawful authority.
I/We grant ChhattisgarhProperty.in a non-exclusive right to host, display, reproduce, resize, technically format and promote submitted listing content for operation, marketing and promotion of the platform, subject to applicable law.

11. PRICE AND AVAILABILITY
The price, rent, brokerage, deposit and availability displayed in a listing are supplied by the uploader.
ChhattisgarhProperty.in does not guarantee that:
- The property remains available;
- The quoted price is the final transaction price;
- The price includes all taxes or charges;
- The property will remain available until a prospective buyer contacts the uploader;
- The stated rental or sale terms will ultimately be accepted.
The uploader shall promptly update/remove a listing when the property is sold, rented, leased, booked, withdrawn or otherwise unavailable.

12. PLATFORM IS NOT A TITLE OR PROPERTY VERIFICATION AUTHORITY
Unless a specific verification service is expressly identified on the platform, publication of a listing shall not mean that ChhattisgarhProperty.in has verified:
- Title;
- Ownership;
- Possession;
- Property measurements;
- Approvals;
- RERA compliance;
- Construction quality;
- Property condition;
- Market value;
- Encumbrances;
- Litigation;
- Seller's authority;
- Buyer's financial capacity;
- Transaction documents.
Users should independently conduct appropriate legal, financial, technical and physical due diligence before entering into any transaction.

13. NO GUARANTEE OF TRANSACTION
ChhattisgarhProperty.in does not guarantee that any listing will result in:
- Sale;
- Purchase;
- Rent;
- Lease;
- Booking;
- Investment;
- Agreement;
- Possession; or
- Any other transaction.
The platform merely facilitates property discovery, listing and communication, subject to the services offered from time to time.

14. NO PAYMENT OR MONEY HANDLING
Unless expressly stated otherwise by ChhattisgarhProperty.in, the platform does not receive or hold:
- Token money;
- Advance payment;
- Booking amount;
- Sale consideration;
- Rent;
- Security deposit;
- Brokerage;
- Property-related payment.
Users should independently verify the identity and bank/payment details of the concerned party before making any payment.

15. FRAUD AND ILLEGAL ACTIVITIES
The platform shall not be used for:
- Fake property listings;
- Identity fraud;
- Impersonation;
- Fake ownership;
- Forged documents;
- Fake RERA registration;
- Fraudulent investment schemes;
- Advance-payment fraud;
- Money laundering;
- Unlawful transactions;
- Spam;
- Misuse of personal information;
- Copyright infringement;
- Any activity prohibited by law.
Where ChhattisgarhProperty.in reasonably suspects fraud, abuse or unlawful activity, it may suspend, restrict or remove the listing/account and may cooperate with competent authorities where required by law.

16. PLATFORM'S RIGHT TO VERIFY
ChhattisgarhProperty.in may, at its discretion, request reasonable supporting information/documents, including:
- Identity proof;
- Ownership documents;
- Authority letter;
- RERA details;
- Agent registration details;
- Project documents;
- Approval information;
- Property photographs;
- Other information reasonably required for verification or safety.
The uploader agrees to cooperate with such requests.
Failure to provide satisfactory information may result in rejection, suspension, restriction or removal of the listing.

17. RIGHT TO REJECT, EDIT, SUSPEND OR REMOVE LISTINGS
ChhattisgarhProperty.in reserves the right, subject to applicable law, to:
- Review listings;
- Reject listings;
- Request clarification;
- Request documents;
- Correct technical/formatting errors;
- Remove duplicate listings;
- Mark listings as unverified;
- Suspend listings;
- Remove listings;
- Restrict accounts;
- Permanently terminate accounts;
- Take other reasonable platform-level measures.
Such action does not constitute a determination by ChhattisgarhProperty.in regarding the legal title or legality of the underlying property unless expressly stated.

18. VERIFIED / FEATURED / PREMIUM LISTINGS
If ChhattisgarhProperty.in provides any Verified, Featured, Premium or similar badge/status, the scope of such status shall be limited to the verification expressly stated by the platform.
Such status shall not automatically mean:
- Title clearance;
- Ownership certification;
- Government approval;
- RERA certification;
- Legal due diligence;
- Guarantee of transaction.

19. USER-TO-USER TRANSACTIONS
All negotiations, property inspections, document verification, payments, agreements, registration, possession and completion of transactions shall be undertaken by the concerned parties.
Users are advised to obtain independent professional advice wherever appropriate.

20. INDEMNIFICATION
To the maximum extent permitted by applicable law, the person/entity that uploads or publishes a listing agrees to indemnify and hold harmless ChhattisgarhProperty.in, its owners, operators, employees, representatives and service providers against claims, losses, damages, liabilities, costs and reasonable legal expenses arising from or relating to:
- False or misleading information submitted by the uploader;
- Unauthorised listing;
- Ownership/title dispute arising from the uploader's representation;
- Fraudulent documents or information;
- RERA/statutory violation attributable to the uploader;
- Copyright or trademark infringement;
- Privacy violation caused by the uploader;
- Fraudulent representation;
- Disputes between buyer and seller;
- Disputes between landlord and tenant;
- Disputes between owner and agent;
- Breach of these Terms by the uploader.
This provision shall operate only to the extent permitted by applicable law.

21. LIMITATION OF PLATFORM LIABILITY
To the maximum extent permitted by applicable law, ChhattisgarhProperty.in shall not be responsible for losses arising from third-party information or conduct, including:
- Incorrect property information;
- False ownership claims;
- Defective or disputed title;
- Fraud committed by a listing user;
- Incorrect pricing;
- Property unavailability;
- Builder/promoter default;
- Agent/broker misconduct;
- Construction delay;
- Failed negotiations;
- Failed transactions;
- Physical defects in property;
- Loss of advance/token/payment made directly to another party.
Nothing in these Terms is intended to exclude or restrict any liability that cannot legally be excluded or restricted.

22. DUPLICATE AND MANIPULATIVE LISTINGS
The same property shall not be repeatedly listed in a manner intended to manipulate search results, create artificial demand or mislead users.
ChhattisgarhProperty.in may merge, hide, restrict or remove duplicate or manipulative listings.

23. DUTY TO UPDATE
I/We shall promptly update the listing whenever there is a material change in:
- Price;
- Availability;
- Ownership;
- Possession;
- Construction status;
- RERA status;
- Property condition;
- Contact details;
- Other material information.
A sold/rented/leased/booked/withdrawn property shall be promptly marked unavailable or removed.

24. USER COMMUNICATION AND CONTACT DETAILS
I/We authorise ChhattisgarhProperty.in to use the contact information provided during registration/listing for legitimate purposes including:
- Account communication;
- Listing communication;
- Verification;
- Customer support;
- Security;
- Fraud prevention;
- Service notifications;
- Transaction enquiries related to the listing.
Marketing communications shall be subject to applicable law and applicable consent/preferences.

25. ELECTRONIC ACCEPTANCE AND RECORD
I/We agree that selecting “I Agree”, checking the applicable checkbox, submitting a registration/listing form or otherwise publishing a property shall constitute electronic acceptance of these Terms.
ChhattisgarhProperty.in may maintain electronic records relating to:
- User registration;
- Property listings;
- Listing edits;
- Acceptance of Terms;
- Terms version;
- Date and time of acceptance;
- Communications;
- Verification activity;
- Other relevant platform activity,
for lawful business, security, compliance and dispute-resolution purposes.

26. TERMS VERSION
The Terms applicable to a particular listing shall be the version accepted by the uploader at the relevant time, subject to subsequent amendments permitted under these Terms and applicable law.
ChhattisgarhProperty.in may modify these Terms from time to time.

27. PRIVACY
Personal information shall be handled in accordance with the applicable Privacy Policy of ChhattisgarhProperty.in and applicable data-protection laws.
By registering/listing, the user acknowledges that personal information may be processed for the purposes disclosed in the Privacy Policy and as otherwise permitted by law.

28. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by the laws applicable in India.
Subject to mandatory statutory jurisdiction and rights available under applicable law, disputes relating to these Terms and the operation of ChhattisgarhProperty.in shall be subject to the jurisdiction of the competent courts at Raipur, Chhattisgarh.

I understand that publication of my property on ChhattisgarhProperty.in does not by itself constitute verification, title clearance, legal approval, RERA certification, ownership certification, valuation, endorsement or guarantee of the property or transaction by ChhattisgarhProperty.in.
